A divorce – called “dissolution of marriage” in Colorado – is initiated by filing a Summons and Petition in the District Court. The court then issues a case management order that outlines requirements for conducting the case, and it schedules an Initial Status Conference. Each party must present financial documents (such as tax returns and account statements) and fully disclose assets. If children are involved, the Court determines what is in the child’s best interests. After disclosure, the settlement process begins, and a mediator may be asked to assist the parties and their attorneys in reaching a settlement. Parties who settle without dispute may then submit their written agreement to the Court for its approval.

If the settlement attempt fails, a judge will hold a hearing and issue orders regarding parental responsibilities (decision-making and parenting time), child support, division of marital assets and debts, and spousal maintenance (alimony).
